Website in One Week™ (“we”, “us”, “our”) is a business owned and operated by Birdcage Group Pty Ltd 79 629 184 210, an Australian-registered company specialising in marketing, business consulting, and digital services.
By purchasing, booking, or engaging Website in One Week™, you (“the Client”, “you”, “your”) agree to the following Terms of Service.
1. Scope of Service
Website in One Week™ provides done-for-you website design and development services on the WordPress platform using the Divi Theme.
Our offer is a streamlined service that delivers a complete website within approximately seven (7) business days, subject to all requirements outlined in Section 3 being met.
2. Ownership and Intellectual Property
Once your website has been completed, approved, and handed over:
- Full ownership of the website content and design is transferred to you.
- All website files, images, and copy supplied by you remain your property.
- Any assets or tools created by Website in One Week™ (including templates, systems, and proprietary workflows) remain the intellectual property of Birdcage Group Pty Ltd.
3. Project Start Requirements
We cannot begin work until all of the following have been completed:
- Full payment has been received and cleared.
- Client questionnaire has been completed in full.
- Images have been supplied, or you have opted for an Image/Photography Pack.
- Copywriting has been supplied, or you have purchased a Copywriting Add-On.
If any of the above items are missing or incomplete, your project start date may be delayed without refund or compensation.
4. Payment Terms
- Payment is required in full upfront to secure your build week.
- Payments are non-refundable under any circumstance, including change of mind, delay in providing materials, or dissatisfaction with subjective design preferences.
- If you fail to provide required content or approvals, the project may be paused and rescheduled at our discretion.
We invest resources and schedule production time specifically for your project; refunds are therefore not available once payment is made.
5. Delivery Timeframe
While our process is designed to deliver a completed website within one week, this timeframe assumes:
- All required assets are provided on time.
- Feedback and approvals are provided within 24 hours of request.
Delays in client response or supply of materials will extend the completion date.
6. Hosting, Domain, and Migration
a. Hosting Through Us
- We provide hosting and domain management through our Birdcage Group Reseller Account.
- You will be billed annually by Birdcage Group Pty Ltd for hosting and domain renewals.
- If you choose to move hosting or domain management away from us, a migration fee of $AU399 applies.
- You must provide admin-level access to your new hosting and domain provider for the transfer to occur.
b. Hosting Through You
- If you supply your own hosting, you must provide full admin access to both your domain and hosting account.
- We take no responsibility for hosting or server-related issues on third-party environments.
- You are responsible for maintaining backups, security, and updates.
7. Divi Theme Licensing
- All websites are built using the Divi Theme (by Elegant Themes) on WordPress.
- If you host with us, your website is covered under our Divi license.
- If you host independently, you must maintain your own Elegant Themes subscription to ensure updates and future compatibility.
- We do not provide technical support or theme updates for clients without an active Elegant Themes license.
8. SEO (Search Engine Optimisation)
All websites are optimised for on-page SEO best practices (e.g., page titles, meta descriptions, headings, and site structure).
However, we make no guarantee that your website will rank or appear in search results on Google or any other search engine.
9. After Handover and Maintenance
Once the website is handed over and approved:
- You have full access and control to make changes, manage content, and perform updates.
- We are not responsible for issues arising from client-made edits, plugin updates, or third-party interference unless you are on an active Maintenance Package.
If you are on a Maintenance Package:
- We will provide ongoing updates, backups, and support limited to 1 hour per month which do not accrue. Any change requests that go above the 1 hour allowance will be quoted for client approval prior to works commencing.
- If you make edits that result in errors, breakages, or site malfunctions, additional work to repair these issues will be billed at our current hourly rate.
10. Revisions and Approval
Each project includes one round of minor revisions to be delivered on day 5 of the project.
Client is to provide minor revisions only (text changes etc.) within 24-hours, or the project will be delayed.
Additional revisions or structural changes may incur extra fees.
Final approval must be provided in writing (email is sufficient). Once approved, the project is considered complete.
11. Client Responsibilities
You are responsible for:
- Providing accurate and complete information throughout the project.
- Supplying any required logins, brand assets, and approvals promptly.
- Ensuring all content and materials provided do not infringe any copyright, trademark, or third-party rights.
We are not liable for any issues arising from inaccurate, unlawful, or incomplete information provided by you.
12. Limitation of Liability
To the extent permitted by law:
- We exclude all liability for any loss, damage, or claim arising from the use or inability to use your website.
- We are not responsible for downtime, security breaches, or issues caused by external hosting providers, plugins, or user actions.
- Our total liability under these Terms is limited to the total amount paid for the website build.
13. Confidentiality
We respect your confidentiality and will not disclose any project-related information to third parties without your consent, except as required by law.
14. Marketing Rights
You grant Website in One Week™ and Birdcage Group Pty Ltd the right to showcase your completed website in our marketing materials, portfolio, and social media, unless otherwise agreed in writing.
15. Termination
We reserve the right to terminate a project if:
- You fail to provide necessary information or materials within a reasonable timeframe; or
- Communication becomes unprofessional or abusive.
In such cases, no refund will be issued.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of Queensland, Australia.
Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
17. Agreement
By engaging Website in One Week™, you acknowledge that you have read, understood, and agreed to these Terms of Service.
